Florida auto cases usually start with PIP. When that $10,000 medical bucket is gone — often in the first month — the client still needs the bottle, and the firm still needs a dated fill record.

A pharmacy deferred payment provider is a deferred payment provider that pays retail or mail-order pharmacies for injury-related prescriptions during the case, documents every fill, and is repaid by the law firm from case proceeds. In Florida that is how PI firms keep medication access after PIP exhaust without sending the client to a cash register. The client fills at $0 out-of-pocket. The firm repays at settlement. Searchers call this a pharmacy lien, a lien pharmacy, or an LOP pharmacy. The category name is deferred payment provider: a company that furnishes injury-related goods or services to a personal-injury client today and is repaid from settlement or judgment proceeds rather than at the point of service.

The Florida mechanism (PIP first, then deferred payment)

Florida has a hospital-lien statute. It does not have a comprehensive outpatient pharmacy-lien statute. Pharmacy deferred payment here is contractual — a lien agreement or letter of protection the firm acknowledges — enforced against the recovery, not recorded like a hospital lien.

PIP is the local hook. Under Fla. Stat. § 627.736, personal injury protection pays medical benefits (including prescription drugs that meet the statute) up to the policy’s medical limit, commonly $10,000, subject to reporting and utilization rules. Once PIP is exhausted, there is no Florida no-fault pharmacy safety net left. A deferred payment pharmacy card is the practical path so the client is not choosing between a copay they cannot float and a gap the defense will read as “resolved.”

HB 837 (2023) changed the fault rule. Florida is not pure comparative negligence. Fla. Stat. § 768.81, as amended, is modified comparative fault with a 51% bar: a claimant 51% or more at fault recovers nothing. PIP exhaust + walk-in is the Florida Access cut. A single-source mail-order tote cannot answer a Saturday call after the PIP card declines. A network can.
